ARA: The apartment complex now won't let me have the dog ... - Blogs

I recently moved into a brand new apartment building in Cohoes, NY. Part of the reason I chose this building was because they allowed pets. Shortly after moving in I inquired about the pet policy to ensure that I chose a breed that fit within their restrictions. At that time management said: ?we are allowing pets that are 15 lbs and under.?

I bought a Cavalier King Charles Spaniel puppy but was then told by management that I could not have the dog because that breeds weight range is between 13-18lbs and therefore, has the potential for going over the 15lbs weight limit. I tried everything to convince management that the dog would not go over the 15lbs and even had the breeder contact them to explain that he will most likely remain small because his parents are small, both under 13lbs.

This sent me on a quest to seek out other tenants in the building with dogs. I found a couple who own an adult 13lbs daschund. Please note: this breeds typical weight standard is from 16-32lbs, well over the 15lbs limit. This couple informed me that when they were going through the leasing process, management informed them that they should lie about their dog?s breed and put down that he is a ?tween? daschund.

I spent a lot of time researching the term ?tween? daschund and have discovered that it is really a made up a term for daschunds that weigh between 13-16lbs. I then hypothetically asked management if I could get a puppy ?tween? dashund. They ignored my inquiry but reiterated that the daschund was okayed to live in the building because he was an adult dog and therefore, they didn?t have to guestimate his adult weight. I asked her if she had weighed the dashund upon move in, saw vet papers or if she has even laid eyes on the dog. To all three questions she replied no. I then asked if she had a plan in place for if the 13lbs dashund gains 2 lbs and is over the allowed limit. To which she responded, that she couldn?t possibly weigh everyone?s dog.

After much back and forth, I requested to see their pet policy formally in writing and received an email stating: ?any adult dog 15 lbs or under and any puppy where the breed has an expected adult weight of 15 lbs or under.?

I then requested that she add a ?tween? Cavalier King Charles Spaniel to my lease. If one tenant is allowed to lie about the breed of their pet, shouldn?t all tenants?

Since being told that I could not get the breed of my choice, I was able to find a breed very similar to the dog I wanted but smaller, therefore, my pet would fit perfectly within the building?s restrictions. I contacted management to ensure that this breed was okay and she emailed me back requesting to see the dog?s papers. Management has not requested to see any other pet owner?s animal?s papers and they even said that it would be unrealistic to ask for every tenant?s pet?s paperwork

I?ve reached out to all my neighbors and it appears that I?m not the only one who has been lied to and misinformed about the pet policy. It is very clear that management has told us one thing to get us to sign our leases and then once they are signed and we move in, the policies change. 1 neighbor is in danger of losing a stray terrier mix puppy because management told her she cannot have him because his breed in unknown. Are they now only allowing purebred puppies? Please help!

I?ve tried to approach this issue from various different angles and I?m continuously being met with resistance from my landlord. I?ve even recommended that they charge pet owners a 1 time fee or additional rent. Does anyone have any ideas?
