Your Dystopian-Style Bernal Heights Real Estate Market Summary ...

Completely independent of the actual data it provides about the state of the Bernal Heights real estate market in September 2012, I think there is something unsettling about the tone and style of this video.

    Apple loses tablet copyright appeal against Samsung

    LONDON (Reuters) - Apple has lost its appeal against a ruling that cleared rival Samsung of copying its registered designs for tablet computers, in a decision which could end the two firms' legal dispute on the subject across Europe.

    The world's two leading smartphone makers are fighting over patents, both for smartphones and for tablets like Apple's iPad, in courts around the world.

    Britain's Court of Appeal on Thursday upheld the country's High Court judgment that, despite some similarities, Samsung's Galaxy tablet did not infringe Apple's designs, in part because its products were "not as cool".

    The decision is valid throughout Europe and should prohibit further legal disputes between the two companies over the design of tablets in the region.

    South Korea's Samsung welcomed the decision saying in a statement: "We continue to believe that Apple was not the first to design a tablet with a rectangular shape and rounded corners".

    Apple declined to comment on the decision.

    The U.S. company has been instructed to run advertisements saying Samsung did not copy its registered tablet designs, both on its website and in selected newspapers.

    Apple can appeal to the Supreme Court.

    "I expect this will be the end of the line. An appeal to the Supreme Court is in principle possible but there has been no indication so far that Apple plan such an appeal", Darren Smyth partner at EIP, a specialist intellectual property law firm, told Reuters.

    "For the design of tablets in Europe this should be the final word."

    Another big idea of his is a much more strengthened and democratic European parliament.

    As Der Spiegel notes, the ideas aren't necessarily new, but it's interesting that someone of his stature is pursuing them aggressively.

    Unfortunately, the ideas still seem more about deficit targets and austerity and so on, rather than actual transfers (which is what will be needed). Also, this will cause howls from people worried about democratic legitimacy.

    River Birch landfill executive Dominick Fazzio and his brother-in-law, Mark Titus, are expected to plead not guilty to recent tax evasion and fraud charges at court appearances set for Tuesday afternoon.

    Both Fazzio and Titus, who last year were charged in an alleged fraud scheme, were hit with new accusations in a superseding indictment filed Thursday. Their arraignment on the new charges, at which they can enter an initial plea, is set for 1 p.m. in U.S. Magistrate Judge Alma Chasez' courtroom.

    The 27-page indictment filed Thursday slapped Fazzio with 30 criminal counts that included tax evasion, conspiracy, wire fraud and money laundering. Prosecutors allege that Fazzio conspired with business owner Hank Ton to pay employees in Ton's companies under the table and reduce the firms' payroll-tax obligation. The indictment said the scheme defrauded the government of about $3.6 million in taxes. Prosecutors named Ton as a co-conspirator in the indictment, but didn't file charges against him. Sources last week confirmed Ton is negotiating a plea deal to cooperate with the government and will face relatively minor charges as soon as this week.

    Fazzio's attorney, Arthur "Buddy" Lemann, said Monday his client will plead not guilty at his arraignment. Lemann has said Fazzio prepared tax filings for Ton's businesses using information Ton provided. If there was anything illegal, Lemann has said, it was Ton's doing.

    For his part, Titus will find himself back in court less than a week after he was sentenced to five years for his role in a scheme to embezzle more than $1 million from Garner Services, a firm he co-owns. The five-year sentence came as part of a plea deal in which Titus admitted to conspiracy to commit mail fraud. But last week's indictment added more than a dozen new charges against Titus related to the Garner scheme, including wire and mail fraud, money laundering and conspiracy.

    Titus' attorney, Jimmy Ardoin, said last week his client will plead not guilty at his new arraignment.

U.S. Secretary of State Hillary Rodham Clinton is answering Republican criticism of the Obama administration's handling of last month's attack at the U.S. consulate in Benghazi, Libya, saying she ? not the White House ? is responsible for security at all of America's diplomatic missions.

    "I take responsibility," Clinton told CNN. "I'm in charge of the State Department's 60,000-plus people all over the world (at) 275 posts."

    With only weeks before the presidential election, outrage has crystallized around Vice President Joe Biden's claim in last week's debate with Republican vice presidential nominee Paul Ryan that "we weren't told" about requests for extra security at the consulate where assailants killed U.S. Ambassador Chris Stevens and three other Americans.

    Congressional hearings revealed that the State Department was aware of, and rejected, several requests for increased security in Benghazi. Spokesmen for both the State Department and the White House took pains Friday to make clear that Biden's "we" referred to the White House, where such requests would not go.

    Clinton backed up Biden's assertion. "The president and the vice president wouldn't be knowledgeable about specific decisions that are made by security professionals," she said Monday.

    Clinton told Fox News Channel that "the decisions about security are made by security professionals. But we're going to review everything to be sure we're doing what needs to be done in an increasingly risky environment."

    There are three separate investigations into the attack going on now: an FBI probe into the deaths of the four Americans, an independent inquiry by a panel appointed by Clinton and the congressional hearings.

    Initial reports attributed the cause of the violent attack as one of a number of spontaneous demonstrations in several Muslim countries over a film produced in the U.S. that denigrated the Prophet Muhammad.     "If the president was truly not aware of this rising threat level in Benghazi, then we have lost confidence in his national security team, whose responsibility it is to keep the president informed," Sens. John McCain of Arizona, Lindsey Graham of South Carolina and Kelly Ayotte of New Hampshire said in a statement released late Monday. "But if the President was aware of these earlier attacks in Benghazi prior to the events of September 11, 2012, then he bears full responsibility for any security failures that occurred."

    Bloomberg News reported Sunday that Ambassador Stevens' father said he believes his son's death is being investigated adequately and said it would be "abhorrent to make this into a campaign issue."

    Clinton agreed with the need to keep the Benghazi tragedy out of politics.

    "I know that we're very close to an election," Clinton told CNN. "I want to just take a step back here and say from my own experience, we are at our best as Americans when we pull together. I've done that with Democratic presidents and Republican presidents."

    Aggregation of proteins in cells may result in diseases

    ScienceDaily (Oct. 15, 2012) ? Changes in the structure of proteins can lead to various diseases, such as Alzheimer's, type 2 diabetes and corneal dystrophy. A research team from Aarhus University has now discovered how a particular protein can damage cells. These results may lead to the development of drugs to treat corneal dystrophy in the future..

    Many diseases are caused by proteins losing their natural three-dimensional structure and thus their function. In most cases, the damaged proteins are degraded by different systems in the cells, but in some cases, the proteins begin to aggregate and form very well-organised rope-like structures called fibrils. These structures have now been linked to many different diseases, such as Alzheimer's, Parkinson's, type 2 diabetes and corneal dystrophies (opaqueness in the cornea).

    It has long been known that corneal dystrophy is caused by a mutation of a protein called TGFBIp in the cornea. This causes the protein to aggregate over a number of years, which finally makes the cornea opaque, eventually leading to blindness. Corneal dystrophy is hereditary, and there is currently no treatment for this disease. The only alternative is a corneal transplant, but even after a transplant, some patients experience a recurrence of the symptoms. It is therefore important to find a reason for this aggregation, and this is what the Aarhus researchers have just accomplished.

    High amounts of TGFBIp protein are damaging

    The research team studied the protein that causes corneal dystrophy, and they found that the mutation of the protein changes its stability. When the protein involved in corneal dystrophy is present in low amounts, the change from a protein with a natural structure to well-organised fibrils is a slow process, and it takes place via several different intermediate stages. In this case, the cell damage is minimal. However, when protein is present in larger quantities, the change from a protein with a natural structure to fibrils is very rapid and involves very few and well-defined intermediate stages. On the other hand, this leads to extensive cell damage.

    With these studies, the researchers gained unique insight into how the amount of protein in solution can determine the mechanism underlying the formation of well-organised protein fibrils.

    The results may explain why some diseases with a prevalence of fibrils result in cell death, while others do not. With this knowledge, it might be possible in the future to prevent this aggregation of damaging proteins by developing drugs for the treatment of corneal dystrophy.

    The researchers behind the results, which have just been published in the international Journal of Biological Chemistry (JBC), are affiliated with the Danish National Research Foundation's Centre for Insoluble Protein Structures (inSPIN) located at the Interdisciplinary Nanoscience Center (iNANO) and the Department of Molecular Biology and Genetics (MBG), Aarhus University, Denmark.

    After years of sitting and listening to competitive coaches, I am struck by their relationship with fun.? They will talk at length about offense, defense, discipline, and effort.... and a bit after the fact say, "and yeah, it needs to be fun."? Sometimes a shrug of the shoulder accompanies this afterthought.? Ultimately, a rather unconvincing advocacy for fun.? Coaches get regularly called to task by more politically correct sects for being out of touch and borderline abusive... and sometimes rightfully so.? Yet, not in this case, the shrug and "well sure I guess it's important," approach to fun is onto something.

    There is a problem with fun.? It is the wrong word that creates the wrong idea... especially at more adult levels of competition (teenage years on).? Words matter.? They create cognitive schemas and shape behaviors.? Fun is the right idea, but the wrong mental message.

    Fun sends a message of trivalness and purposeless living.? Fun, in the pleasurable sense, is hedonistic.? This is why it does not seem to sit right with many people who are engaged in competitive sport.? Fun is a lazy tropical vacation, not an early morning row on the river.? Fun is dinner with friends and a movie, not racing around a soccer pitch on a rainy afternoon.? The word "fun" occupies space in many minds that does not fit the emotion of striving on the playing field.?

    So abandon the idea all together?? Certainly not.? Refine thinking and reword things a bit.?

    At the foundation of play is "enjoyment."? An activity that engages interest and challenges the individual appropriately.? Mihaly Csikszentmihalyi, father of Flow, articulates this concept so well: "[competitive sport] that stretches one's ability is enjoyable;" "after an enjoyable event, we know that we have changed;" "enjoyment happens only as a result of unusual investments of attention." (Csikszentmihalyi and Csikszentmihalyi, 1998)? Enjoyment involves effort, both mental and physical.? It does not occur during trivial endeavors, but rather as part of a purpose driven life.? Effortful and purpose driven... sounds like sports.

    Sport at all levels ought to be enjoyable.? This comes from embracing the many challenges of competition.? It also comes from abandoning the juvenille concept of fun.? The youngest athletes get enjoyment - they experiment with new techniques, they dare opponents to strike them out, they relish the brisk fall afternoons of play, and they strive with healthy grimaces on their faces.? To a casual observer, it would look like they are having fun... sure maybe, but truly they have mastered the enjoyment necessary for success at all stages and ages of sport.

    Hedge fund giant Brevan Howard hunts for new London home

    LONDON (Reuters) - Brevan Howard, one of the world's top hedge fund firms which three years ago moved its main office to lower-tax Geneva, is back hunting for a new home in London amid signs some traders are missing the city's buzzing nightlife.

    Brevan, headed by co-founder Alan Howard and which manages $37 billion (23 billion pounds) in assets, is considering taking more than half the office space in a 65,000 square feet development at 7-8 St James's Square in the heart of London's plush hedge fund district, three property agents told Reuters.

    The offices would replace Brevan's cheaper 38,000 square foot offices on Baker Street, where nearly half of Brevan's 400 staff worldwide are still currently located.

    They could also provide a home for some of its Swiss-based executives - who include Alan Howard and founding partner Nagi Kawkabani - amid speculation among executives in London and Geneva that some Brevan traders may be disillusioned with life away from London's swanky restaurants and upmarket shops.

    "I've heard that some of the traders who made the move out to Geneva have since come to regret that decision," said one prominent London-based hedge fund investor. "It seems that life in a small city doesn't always outweigh the tax savings."

    Any such move would be a coup for Britain, which has been trying to position itself as a lower-tax base for entrepreneurs as it battles slow economic growth and a huge budget deficit.

    Brevan Howard declined to comment.

    "I heard a number of traders who came over want to head back. Everyone knows Alan Howard isn't happy here," said one Geneva-based hedge fund professional, who asked not to be named.

    Just over 100 of Brevan's staff are based in the Swiss city.

    Reuters revealed Brevan's plans to open a Geneva office in 2009. The firm said at the time it was for staff who wanted to move "for personal reasons" and that the move had nothing to do with an imminent rise in tax rates for top earners in Britain.

    However, since Brevan's move conditions have become more difficult for Swiss-based hedge fund managers.

    The Swiss franc has strengthened by around 20 percent against the dollar - in which most hedge fund firms earn their revenues - since the first half of 2010, increasing many of their staff and office costs.

    Meanwhile, the top rate of income tax in Britain is to fall back to 45 percent from 50 percent, while the top marginal tax rate in Geneva is 44 percent.

    And new Swiss regulation of fund managers is set to come in next year, effectively making Switzerland less attractive as a haven for those looking to escape tough EU rules.

    Hiring staff in areas such as technology can be tricky in Geneva, while the Swiss city's more sedate lifestyle is not to everyone's taste.

    "It's good for families - the trains are fast and the commute is shorter (than in London)," said one Swiss-based manager. "Single guys (who moved from London to Switzerland) do wakeboarding and skiing. But they miss the nightlife of London."

    Rather than relocating staff to another country, as a multinational company may do, Brevan's policy is to allow staff to choose where they want to be based.

    Brevan pays a reported 75 pounds per square foot at Baker Street, meaning its annual rent is likely to be around 28.5 million pounds. Rent would be more like 110-120 pounds per square foot at the St James's Square site, property agents said.

    Brevan is looking for up to 40,000 square feet, two of the agents told Reuters. A typical 40,000 square foot office would hold 350-375 people.

    The St James's Square development is due to complete late next year.

    Brevan is best known for its $27 billion Master fund, which has never had a losing year and which made 21 percent in the market turmoil of 2008. Last year it rose 12.2 percent, while this year it is up 2.05 percent after strong gains in September.
